The National Labor Relations Board Election Process

As the date for your election approaches, the NLRB will post a Notice of Election at the workplace to inform you of:

  • The date, hours, and place of the election.

  • The payroll period cut off date for voter eligibility.

  • A description of the voting unit of employees; and

  • General rules as to conduct of elections.

There is a sample ballot printed on the Notice of Election.  Except for its color, it is a Reproduction of the ballot you will
actually use when you vote.  Be sure to read the Notice of Election so you are familiar with the ballot.

The U.S. Government Guarantees Your Secret Ballot.

When it is time to vote in an NLRB election, seated in the polling place will be a union observer (one of your fellow workers),
the NLRB agent who conducts the election, and a company observer.

You will give your name and employee number and then representatives will check your name off the official list of eligible
voters so no one else can vote under your name to make sure no one can vote twice.  The Government agent will then give
you a ballot, but it does NOT list your name or employee number or contain any other means of identification.  The ballot you
receive will simply ask if you want the UMWA to represent you in negotiations on your wages, benefits, and working
conditions.  It is a simple yes or no ballot.  You will go into the voting booth, which is designed to give you privacy and to
prevent anyone from seeing how you mark you ballot.  After you have marked your ballot, you will fold it so no one can see
how it is marked and leave the voting booth.  You will then drop the folded-up ballot into a secure ballot box which only the
Government can open.  Your ballot is mixed in with all the other ballots cast by your fellow workers.

After the polls are closed, the Government agent dumps the ballots on a table and begins counting them.  The Government
agent counts the votes as Union and company representatives (including the election observers) watch.  After announcing
the election results, the Government agent seals up the ballots.
